The Faculty of Law and the Centre for Law, Governance and Public Policy would like to invite you to a presentation by
Dr Robert Moles on the "Miscarriages of Justice and Australian Criminal Appeals - a failure of human rights and the 'rule of law'."
Dr Moles will talk about an appalling litany of wrongful convictions which have occurred. His articles have led to an admission from the Australian Human Rights Commission that: the criminal appeal system in Australia fails to comply with international human rights obligations (the ICCPR), it has failed to protect the right to a fair trial, it has failed to protect the right of the wrongfully convicted to a proper appeal. For 30 years no one seems to have noticed the problem. How can that have occurred? And why isn't something being done about it?
Wrongful convictions - innocent people in prison whilst the guilty go free?
Henry Keogh - year 17 of 26 years - no real evidence of any criminal event having occurred.
David Szach - 14 years served - now out and suffering from motor neurone disease - clearly wrongly convicted.
David Bromley - 27 years served - still in prison 5 years over his sentence - says he is innocent so not allowed parole.
Baby Deaths - 3 months - 9 months - clearly beaten to death - pathologist called it "bronchopneumonia" - no prosecutions!
