ESOS FrameworkThe Department of Industry, Innovation, Science, Research and Tertiary Education regulates the education and training sector’s involvement with overseas students studying in Australia on student visas through the Education Services for Overseas Students (ESOS) legislative framework. The ESOS framework is designed to protect the interests of overseas students by setting out standards, roles and responsibilities for education institutions that teach overseas students, as well as providing tuition and financial assurance for students. Bond University adhers to the principles and guidlines of the ESOS Framework. Student Visa RegulationsThe following is a summary of the regulations regarding your Student Visa. It is important you understand and comply with these regulations as Bond University is legally obliged to report any Student Visa breach to the Department of Immigration and Citizenship (DIAC) within 14 days of a breach and your Student Visa may be cancelled.
As your Education Provider we maintain all information regarding your address details (s21 ESOS Act 2000), academic records and enrolment status (ESOS 2001 regulation 4.01). It is your responsibility to ensure that any information held by Bond University is up to date and that you comply with all relevant regulations. Failure to comply with any of the following could result in your visa being cancelled. RESIDENTIAL ADDRESS – STUDENT VISA REGULATION 8533 You are required to provide Bond University with your Australian residential/contact address within 7 days of arriving in Australia and any address changes that you may have whilst residing in Australia. This CANNOT be a post office box; it must be a physical residential address. How to ensure compliance: use eStudent to update your current Australian address within 7 days of any changes. FULLTIME ENROLMENT – STUDENT VISA REGULATION 8202 UNDERGRADUATE STUDENTS
You must be enrolled in a full-time study load each semester. Bond University considers a full-time study load for undergraduate students to be the equivalent 40 credit points semester - (4 subjects per semester). The only exception to this is in your final semester of enrolment if you require less than 40 credit points to complete your course. POSTGRADUATE MASTERS STUDENTS A full-time study load for postgraduate students is 30 credit points per semester - (3 subjects per semester). The only exception to this is in your final semester of enrolment if you require less than 30 credit points to complete your course. * This does not apply to JD students who require a full-time study load of 40 credit points
POSTGRADUATE DIPLOMAS, GRADUATE CERTIFICATES, GRADUATE DIPLOMAS A full-time study load for students enrolled in the above programs is 40 credit points per semester - (4 subjects per semester). The only exception to this is in your final semester of enrolment if you require less than 40 credit points to complete your course. How to ensure compliance: Maintain full time enrolment in all semesters. If you have concerns about subject availability, see your Program Adviser. ACADEMIC PERFORMANCE – STUDENT VISA REGULATION 8202 Each semester Bond University Academic Performance regulations require you to achieve a Grade Point Average (GPA) of at least 0.5. Anything below this is considered unsatisfactory performance. Student Administration reserves the right to report any failure of a subject regardless of the semester Grade Point Average. How to ensure compliance: Your Academic Adviser can assist you in planning your academic program. If you are experiencing any problems please inform the International Student Compliance Officer who can also offer advice and assistance, specifically where your visa is concerned. OVERSEAS HEALTH COVER – STUDENT VISA REGULATION 8501 It is your responsibility to maintain Overseas Student Health Cover whilst you are on a Student Visa. Our preferred provider is OSHC Worldcare (telephone: 07-33057000 or the Website: www.oshcallianzassistance.com.au). You are able to re-new your health cover with OSHC Worldcare in Student Administration in the self service area or in person on a weekly basis. Please contact Student Administration for times an OSHC Worldcare representative will be in Student Administration to assist you.
Please Note: All student visa applicants for all student visa subclasses must provide evidence to DIAC of OSHC for the entire estimated duration of ther visa. TU 574 (Post Graduate Research) applications lodged on or after 5 November 2011 will be eligible for an additional six months visa length. This is to allow six months for the marking of a thesis and must show OSHC that alos covers this period. DEFERRAL You can defer your studies for ONE SEMESTER ONLY or for a maximum period of six months subject to cases of COMPELLING AND/OR COMPASSIONATE circumstances only. Your reason for deferral MUST be supported by original documentation. If appropriate documentation is not supplied, you will not be granted a deferment: you will be withdrawn – this will cancel your student visa. Once you have been granted a deferral, you are required to leave the country during this period. DIAC do regular checks of deferred students to ensure they have left the country. On return you need to be enrolled and back in Australia before the commencement of classes for the next semester. If you defer for more than one semester you will need to contact DIAC as they may cancel your Student Visa. How to ensure compliance: Complete the Deferral Form available at Student Administration and arrange an appointment with your Academic Adviser and the Compliance Officer located in Student Administration. Please Note: If the Compliance Officer has not approved your leave you will be reported to DIAC and withdrawn from the University
PERMISSION TO WORK – STUDENT VISA REGULATION 8101 Requirement: If you were granted a Student visa on or after 26 April 2008, you will already have Permission to Work automatically included with your visa. Further information about the conditions that apply to working while studying is available from the immigration website. You are entitled to work a MAXIMUM of 40 hours per fortnight whilst on a Student Visa. During official semester breaks you have unlimited work hours. You must obtain a Tax File Number to be able to work in Australia. This is available from the Australian Tax Office www.ato.gov.au
APPLYING FOR A FURTHER STUDENT VISA It is a now a requirement that international students complete their studies within the time specified on their Confirmation of Enrolment (CoE). If you have not been able to complete your degree within the time frame allowed on your current Student Visa you will need to apply for a new Student Visa to cover this extra time. Please obtain a “Request for Electronic Confirmation of Enrolment (CoE)” form from Student Administration; complete and submit the form to Student Administration. You will need to provide Student Administration with compelling or compassionate reasons why you were not able to complete your studies within the expected duration of study. The new CoE will be emailed to your Bond University student email account. PLEASE NOTE – for a new CoE to be issued you must provide documented evidence of compassionate/compelling reasons why you were not able to complete your studies in the time given on the original CoE. Graduating International Students Your student visa is valid only while you are studying in Australia. Please read the International Student Visa Requirements carefully to ensure you leave the country as expected by the Immigration department.
